Court To Rule On Metuh’s Case On March 9
Justice Obong Abang said that he would either deliver judgment to dismiss the charges against Mr Metuh and acquit him if he finds that he has no case to answer.
He, however, said that he would in the alternative, deliver a ruling ordering Mr Metuh to open his defence, if he finds out that he has a case to answer.
Justice Obong reached his decision after Mr Metuh filed documents and adopted same as his submission to prove that the EFCC has not made out any case against him.
At the resumed hearing, the defense counsel, Onyechi Ikpeazu, told the court that there is no case submission based on what have been filed by the prosecution.
He said a point of law which was filed on February 24 should be considered as a reply to the submission of no case made by the defense. But the prosecuting counsel, Sylvanus Tahir, said he had received a written address and had filed a reply to it.
At this, the judge, Okon Abang adjourned the matter for either ruling or judgment on the no case submission. He said: "If the no case argument succeeds, the court shall strike out all charges against the defendant but if on the contrary it doesn’t, the defendant shall be called upon to open his defense."
Abang further adjourned to Wednesday, March 9. He ruled that should the defense open his case, hearing would continue on a daily basis.
Metuh is facing trial on charges bordering on money laundering and criminal breach of trust.
